Ohio has adopted an important new method of a title in real property. The Ohio Transfer on Death Deed
allows the owner of real property to take title in his name alone but to affect a transfer on his death. This transfer
is outside of probate and occurs by operation of law. Previous Ohio law provided for the Joint and Survivor Deed in
which two people owned property and on the death of one of them the remaining person owns the property entirely. The
transfer on death deed, however, allows the owner complete ownership during his life, including the right to change his
transferee, but affects the transfer on his death. This effective tool should be considered as part of estate planning.
